DEVELOP CRIMINAL LAW POLICY RECOMMENDATIONS FOR BOTH PROVINCIAL & FEDERAL APPLICATIONS RE: ALL FORMS OF CYBER CRIMES

WHEREAS the Canadian Victims Bill of Rights, in its Preamble states that crime has a harmful impact on victims and on society;

WHEREAS the Canadian Victims Bill of Rights, in its Preamble states victims of crime and their families deserve to be treated with courtesy, compassion and respect, including respect for their dignity;

WHEREAS the Canadian Victims Bill of Rights, in its Preamble states it is important that victims’ rights be considered throughout the criminal justice system;

WHEREAS the Canadian Victims Bill of Rights, in its Preamble states victims of crime have rights that are guaranteed by the Canadian Charter of Rights and Freedoms;

WHEREAS the Canadian Victims Bill of Rights, in its Preamble states consideration of the rights of victims of crime is in the interest of the proper administration of justice;

WHEREAS the Canadian Victims Bill of Rights, in its Preamble re-informed that the federal, provincial and territorial governments share responsibility for criminal justice;

WHEREAS Frauds, identity theft, extortion, criminal harassment, certain sexual offences, and offences related to child pornography are among the criminal violations that can be committed over the Internet using a computer, tablet, or smart phone ;

WHEREAS cyber violence, includes online threats, harassment, stalking and has emerged as an extension of violence against women ;

WHEREAS cyberbullying and harassment involves the use of communication technologies such as the internet, social networking sites, websites, email, text messaging and instant messaging ;

WHEREAS women are most likely to experience online harassment, and cyber crimes can follow a victim everywhere 24 hours a day, 7 days a week ;

BE IT RESOLVED the Ontario Liberal Party develop Criminal Law policy recommendations for both provincial and federal applications, including consultations with the Federal Department of Justice to - enact and increase harsher penalties, incarceration sentences and criminal code provisions for all indictable offences, for the prosecution of all forms of cyber crime which includes harassment, stalking, violence, bullying and other victimization;

BE IT FURTHER RESOLVED that the Ontario Liberal Party develop Criminal Law policy recommendations for both provincial and federal applications, including consultations with the Federal Department of Justice to - establish and administer special programs such as Victim/Witness Assistance Programs, for victims of all forms of cyber crime which includes harassment, stalking, violence, bullying and other victimization.
